Conditions of Use

By using the Foreign Service Network's services (“Services”), you agree to be subject to the following terms of service (“Terms”), and enter into an agreement with the Foreign Service Network and its Internet platforms foreignservice.network, consularcorps.info, foreignservice.info, honoraryconsulate.network, consulate.network, and embassy.network (“FSN”). FSN’s business address is Flugplatz, 3368 Bleienbach, Switzerland.

By accepting these Terms (see below), you accept that these Terms and the FSN Privacy Policy will apply whenever you use FSN sites and services, as well as the manner in which FSN operates its sites. Some FSN sites, services and tools may have additional or other terms that we provide to you when you use those sites, services or tools.

Our Terms may change from time to time, and those changes will be available for your review on FSN pages that you view.

Accepting The Terms

All users of FSN must accept the Terms to use the Services.

You can accept the Terms by:

  1. Using the Services. FSN offers the Services to you conditioned on your acceptance without modification of the Terms. Your use of the Services constitutes your acceptance of this Agreement; or

  2. Clicking to accept or agree to the Terms, where this option is made available to you by FSN in the user interface for any Service. These Terms contain disclaimers of warranties and liability and exclusive remedy. These provisions form an essential basis of our provision of the Terms and our Services. Please print a copy of these Terms for your records.

    FSN reserves the right to change the terms, conditions, and notices contained in these Terms of Service or otherwise conspicuously posted, under which it offers any of its Services at any time, for any reason, and without notice, and such modifications shall be deemed effective immediately upon posting of the modified terms. You are responsible for regularly viewing these Terms, as your continued use of the Services following the posting of the changes to these Terms will mean you accept those changes.

License and Site Access

FSN grants you a limited license to access and make use of the FSN site and not to download or modify it, or any portion of it, except with express written consent of an officer of FSN. Your license does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site; any downloading or copying of account information for the benefit of another individual or merchant; or any use of data mining, robots, or similar data gathering and extraction tools. This site or any portion of this site, including the services provided on it, may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any personal or commercial purpose without express written consent of FSN. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of FSN without express written consent. You may not use any meta-tags or any other "hidden text" utilizing FSN's name or trademarks without the express written consent of FSN. Any unauthorized use terminates the permission or license granted by FSN. You may not use any FSN logo or other proprietary graphic or trademark as part of the link without express written permission.

User Content, Links, Third Parties

Our websites may contain (a) User Content (defined below) provided by other users, (b) links to other sites operated by third parties, whether affiliated or otherwise, (c) advertisements and/or sponsorships provided by third parties, and (d) services or products offered by third parties ((a)- (d) are collectively, “Third-Party Materials”). We have no control over and are not responsible and assume no liability for any Third-Party Materials or the applicable third parties. We are not responsible for any acts or omissions of such third parties. We do not review, approve, endorse, guarantee, warrant, or make any representations with respect to Third-Party Materials or the applicable third parties. For example, we do not guarantee, warrant or represent that the Third-Party Materials are accurate, legal and/or inoffensive or that these third party sites do not contain viruses or other deleterious software or other harmful or unwanted features that may adversely affect your computer. You use all Third Party Materials and interact with such third parties at your own risk. We are not obligated to be involved in any disputes between you and any such third parties. When you leave our site, our Terms (including our Privacy Policy) no longer govern. You should carefully review the applicable third party privacy statements and other terms and conditions of use. Without limiting the forgoing, if you have an issue with a hyperlink from any one of our sites, please notify our customer support.

You hereby release us, our subsidiaries, affiliates, officers, employees, agents, and successors from any claim, demands, losses, damages, rights, and actions of any kind, including personal injuries, death, and property damage, that is either directly or indirectly related to or arising from use of Third Party Materials or interactions with or conduct of the applicable third parties. In connection with the foregoing, IF YOU ARE A CALIFORNIA RESIDENT, YOU HEREBY WAIVE CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.”

License Granted by You

By providing, submitting, uploading any communications, reviews, comments, feedback, postings, materials, or other content for use on any of the FSN websites (“User Content”), (a) you represent and warrant that you or the owner of all rights to such User Content and that such User Content does not violate our Terms and (b) you hereby grant us, and agree to grant us, an irrevocable, perpetual, royalty-free, fully paid-up, worldwide license (with the right to sublicense) in all languages to use, reproduce, distribute, publicly display, publicly perform, prepare derivative works of, modify, sell and otherwise exploit all or any part of the User Content in our sole discretion by any method now existing or later developed, subject to our Privacy Policy. Subject to our Privacy Policy, any User Content will be treated as non-confidential and non-proprietary and may be disseminated or used by us for any purpose, including, but not limited to, developing, creating, manufacturing or marketing products or services.

Registration and Participation

Access to public information on FSN’s domain does not require registration and is open to any website visitor that agrees to these Terms and FSN’s Privacy Policy. FSN’s products and services (described below) are offered exclusively to individuals that serve as official representatives of cities, municipalities, governments, sovereign nations, and their affiliates, and not to any other individuals, commercial or partly commercial entities. FSN reserves the right to exclude commercial resellers from participation in any site activity and to close any user accounts at any time.

In order to access certain Services, you may be required to provide information about personally identifiable data (such as your name, physical address, email address or other contact details) as part of the registration process for the Service, or as part of your continued use of the Services. You agree that any registration information you give to FSN will always be accurate, correct and current.

You agree and understand that some of your personally identifiable data that is listed in your profile section is accessible by all registered users that are eligible to use FSN’s products and services. All registered users agree and understand to comply with the confidentiality requirements as described in the LICENSE AND SITE ACCESS Section.

You agree and understand that you are responsible for maintaining the confidentiality of passwords associated with any account you use to access the Service and that your user account may be used only by you and not anyone else. Accordingly, you agree that you will be solely responsible to FSN for all activities that occur under your account.

Services

Several services are offered by FSN that are available only to the intended member audience as described in the REGISTRATION AND PARTICIPATION Section. This audience is granted approval to create an authenticated account with FSN and create user-generated content across these FSN services:

Website presence: Eligible members have the ability to create custom websites for informational purposes that are open to the public audience via the honoraryconsulate.network, consulate.network, embassy.network, foreignservice.info, and the consularcorps.info domains. The user-generated content is entirely maintained by the respective content creators and FSN assumes no liability of the content as expressed in the USER CONTENT, LINKS, AND THIRD PARTIES Section.

Collaboration platform: Eligible members have the ability to utilize a collaboration platform that is restricted to the intended member audience and is not for public consumption. The collaboration platform provides more detailed information about individuals that share a common network and provides communication features to engage with fellow members in that same network.

FSN Console: Eligible members have the ability to access the FSN Console where they can make modifications to their own user profile and authorized websites that includes pages, news, and events, and post content via the collaboration features.

All websites, the Collaboration platform, and the FSN Console are hosted on web servers that are paid for by FSN.

Rules, Restrictions, Suspension

Without limiting other remedies, we may limit, suspend, or terminate our Service and user accounts, prohibit access to our sites and their content, services, and tools, delay or remove hosted content, including any User Content and take technical and legal steps to keep users off the sites if we think that they are creating problems or possible legal liabilities, infringing the intellectual property rights of third parties, or acting inconsistently with the letter or spirit of our policies. We also reserve the right to cancel unconfirmed accounts or accounts that have been inactive for a long time, or to modify or discontinue FSN sites, services, or tools.

You agree to the following conditions:

  • You agree to use the Services only for purposes that are permitted by (a) the Terms and (b) any applicable local, state, federal, or international law, regulation or generally accepted practices or guidelines in the relevant jurisdictions (including any laws regarding the export of data or software to and from the United States or other relevant countries). You agree not to post User Content that (i) plagiarizes, violates or infringes upon the rights of any third-party, including trade secret, copyright, trademark, trade dress, privacy, patent, moral right, publicity, or other personal or proprietary rights, and/or (ii) contains unlawful, tortious, threatening, harmful, vulgar, defamatory, false, intentionally misleading, libelous, pornographic, obscene, patently offensive, inappropriate, offensive, harassing, unacceptable material or materials that are harmful to minors, or brings disrepute onto FSN in any manner.
  • You also agree not to engage in any activity that circumvents, interferes with or disrupts the Services (or the servers and networks connected to the Services) or any user experience of our Services including but not limited to the following:
    • using any unauthorized third-party software;
    • accessing any of the Services by means other than through the interface provided by FSN (e.g. no use of scripts or web crawlers);
    • distributing spam, unsolicited, or bulk electronic communications, chain letters, or pyramid schemes; or
    • collecting information about users, including email addresses or any other personally identifiable information (name, physical address, phone number, etc.), without such users’ express consent.

You agree that you are solely responsible for (and that FSN has no responsibility to you or to any third party for) any breach of your obligations under the Terms and for the consequences (including any loss or damage which FSN may suffer) of any such breach. In case of a breach of these Terms, FSN reserves the right to pursue any legal remedies available.

Pricing and Payment

FSN’s services are available via a subscription, which requires the payment of a monthly or annual fee to FSN. The fee, including any discounts and duration, is uniquely determined for each account. FSN may offer free limited access to individuals that utilize the services for the purposes of maintaining person profile or a Consulate, Embassy, or Consular Corps profile or website. The duration of the free usage is determined at sole discretion by FSN and can be cancelled at any time for any reason. FSN also reserves the right to change its fee structure at any time for any reason. Changes in the fee structure will be communicated through the FSN sites and you will be given the option to continue the services at the new price or terminate your agreement with FSN.

Information Inaccuracy Disclaimer

From time to time there may be information on the website that may contain typographical errors, inaccuracies, or omissions that may relate to service and product descriptions, pricing, and availability. FSN reserves the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order). If a service or product offered by FSN is not as described, your sole remedy is to stop using the service or returning the unused product pursuant to our return policy.

Disclaimer of Warranty

THIS SITE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE ARE PROVIDED BY FSN ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING.

NEITHER FSN, ITS AFFILIATES NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, THIRD PARTY CONTENT PROVIDERS, SUPPLIERS OR LICENSORS MAKES ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS SITE OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THIS SITE IS AT YOUR SOLE RISK.

TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, FSN, ITS AFFILIATES, RESPECTIVE EMPLOYEES, AGENTS, THIRD PARTY CONTENT PROVIDERS, SUPPLIERS AND LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE. FSN, ITS AFFILIATES, AGENTS, THIRD PARTY CONTENT PROVIDERS, SUPPLIERS AND LICENSORS DO NOT WARRANT THAT THIS SITE; INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE; THEIR SERVERS; OR E-MAIL SENT FROM FSN ARE FREE OF ERRORS, VIRUSES OR OTHER HARMFUL COMPONENTS. Limitation of Liability

YOU AGREE THAT, EXCEPT AS EXPLICITLY SET FORTH HEREIN, FSN, ITS DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES, SUCCESSORS, LICENSORS, AND SUPPLIERS SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY OF THE FOLLOWING TYPES OF DAMAGES RELATED IN ANY WAY TO OUR RELATIONSHIP WITH YOU (INCLUDING OUR PRODUCTS, SERVICES, OR SITE CONTENT) OR THIRD-PARTY MATERIALS OR WEB SITES: INDIRECT, EXEMPLARY, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOSS OF PROFITS OR GOODWILL, REVENUE, DATA OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, RELATED TO OUR PRODUCTS OR YOUR ACCESS TO, AND USE OF, OUR SITES OR ANY OTHER HYPER-LINKED THIRD PARTY WEB SITE, EVEN IF WE HAVE BEEN ADVISED OF, OR ARE AWARE OF, THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY, OUR LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR RELATED IN ANY WAY TO OUR RELATIONSHIP WITH YOU (INCLUDING OUR PRODUCTS, SERVICES, OR SITE CONTENT), OR THIRD-PARTY MATERIALS OR WEB SITES (FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION), WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID TO FSN FOR THE APPLICABLE TRANSACTION GIVING RISE TO THE LIABILITY, OR, IF THERE IS NO PAID TRANSACTION RELATED TO THE LIABILITY, THE LESSER OF THE AMOUNTS PAID BY YOU TO FSN IN THE PRIOR TWELVE (12) MONTHS AND FIFTY DOLLARS ($50).

CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

System Outage

FSN provides no guarantee for the constant and uninterrupted availability of its website and technical systems. In addition to the provisions of limited liability set forth above, FSN shall not be liable for damage that occurs due to site outages.

Intellectual Property

All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of FSN or its third party members and may be protected by United States and international copyright laws. All software used on this site is the property of FSN or its software suppliers/licensors and may be protected by United States and international copyright laws.

FSN and other graphics, logos, page headers, button icons, scripts, and service names are trademarks, registered trademarks, service marks or trade dress of FSN in the U.S. and/or other countries. FSN's trademarks and trade dress may not be used in connection with any product or service that is not FSN's, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits FSN. All other trademarks not owned by FSN that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by FSN. The absence of a trademark, trade name or service mark from the above list does not constitute a waiver of our intellectual property rights concerning that trademark, trade name or service mark.

One or more patents applications owned by FSN may apply to this site and to the features and services accessible via the site.

Privacy

The protection of your data is very important to us. For more information on the collection, processing, and use of personal data, please read our Privacy Policy.

Changes to the Terms

FSN may make changes to these Terms from time to time. When these changes are made, we will make a new copy of the Terms available to you from within, or through, the FSN services.

You understand and agree that if you use the Services after the date on which the Terms have changed, FSN will treat your use as acceptance of the updated Terms.

Ending Your Relationship with FSN

If you want to terminate your legal agreement with FSN, you may do so by (a) notifying FSN at any time in writing either via mail to FSN’s address which is set out at the beginning of these Terms, or via email to support [at] foreignservice.network, or (b) closing your accounts for all of the Services, which you use, where FSN has made this option available to you.

FSN may at any time, terminate its legal agreement with you if:

  1. you have breached any provision of the Terms (or have acted in manner which clearly shows that you do not intend to, or are unable to comply with the provisions of the Terms); or
  2. FSN is required to do so by law (for example, where the provision of the Services to you is, or becomes, unlawful); or
  3. The provision of the Services to you by FSN is, in FSN’s opinion, no longer commercially viable.
    When these Terms come to an end, all of the legal rights, obligations and liabilities that you and FSN have benefited from, been subject to (or which have accrued over time whilst the Terms have been in force) or which are expressed to continue indefinitely, shall be unaffected by this cessation, and the provisions of the General Legal Terms below shall continue to apply to such rights, obligations and liabilities indefinitely.

DMCA Policy

If you are notifying FSN of alleged copyright infringement, please be sure to provide the following information in the form required by 17 USC Section 512:

  1. A description of the copyrighted work that you allege is being infringed, or, if multiple copyrighted covered by a single notification, a representative list of such works;
  2. A description of the allegedly infringing material and information sufficient to permit us to locate the material;
  3. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and/or an electronic mail address;
  4. A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, or its agent, or the law; and
  5. A statement by you that the information in the notification is accurate and that you have the authority to enforce the copyrights that are claimed to be infringed.

We may terminate the privileges of any user who uses the FSN sites unlawfully to transmit copyrighted material without a license, express consent, valid defense or fair use exemption to do so.

General Legal Terms

Sometimes when you use the Services, you may (as a result of, or through your use of the Services) use a service or download a piece of software, or purchase goods, which are provided by another person or company. Your use of these other services, software or goods may be subject to separate terms between you and the company or person concerned. If so, the Terms do not affect your legal relationship with these other companies or individuals.

The Terms constitute the whole legal agreement between you and FSN and govern your use of the Services (but excluding any services which FSN may provide to you under a separate written agreement), and completely replace any prior agreements between you and FSN in relation to the Services.

You agree that FSN may provide you with notices, including those regarding changes to the Terms, by email, regular mail, or postings on the Services.

You agree that if FSN does not exercise or enforce any legal right or remedy which is contained in the Terms (or which FSN has the benefit of under any applicable law), this will not be taken to be a formal waiver of FSN’s rights and that those rights or remedies will still be available to FSN.

If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms is invalid, then that provision will be removed from the Terms without affecting the rest of the Terms. The remaining provisions of the Terms will continue to be valid and enforceable.

The Terms, and your relationship with FSN under the Terms, shall be governed by the laws of the State of Delaware without regard to its conflict of laws provisions. You and FSN agree to submit to the exclusive jurisdiction of the courts located within the county of Newcastle County, Delaware to resolve any legal matter arising from the Terms. Notwithstanding this, you agree that FSN shall still be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction. The UN Convention on the International Sale of Goods shall not apply.

The contract between you and FSN is binding on the parties and on their respective successors and assigns. You may not transfer, assign, charge or otherwise dispose of any contract formed under these Terms or any of their rights or obligations without FSN’s prior written consent.

These Terms set forth the entire understanding and agreement between us with respect to the subject matter hereof. The following Sections survive any termination of these Terms: Payment (with respect to fees or amounts owed for our services or products where applicable), Disclaimer of Warranties, Limitation of Liability, Intellectual Property and General Legal Terms.
